1. Introduction and Agreement

Welcome to Appfleece, s.r.o. ("Company", "we", "our", "us")! These Terms of Service ("Terms") govern your use of our Shopify applications and related services.

By installing any of our apps from the Shopify App Store, you enter into a binding agreement with us and agree to these Terms. If you don't agree with these Terms, please don't install or use our services.

Business Use Only: Our services are designed for Shopify merchants operating e-commerce businesses. You represent that you have the authority to enter into this agreement on behalf of your business.

Scope: These Terms apply to our Shopify applications and website usage. Other services (such as consulting or development work) may be available separately under different terms.

2. Website Usage

These Terms also apply to your use of our websites (appfleece.com, appfleece.cz), including:

  • Browsing content and blog posts
  • Using contact forms and requesting information
  • Downloading resources, guides, or files
  • Any other website interactions

3. Shopify App Services

We develop and provide Shopify applications designed to enhance your e-commerce operations.

Service Requirements

  • Active Shopify store with appropriate plan for app requirements
  • Valid payment method linked to your Shopify account
  • Compliance with Shopify's Terms of Service and Acceptable Use Policy
  • Acceptance of necessary app permissions for functionality

4. Subscription and Billing

Automatic Renewal and Cancellation

  • Subscriptions automatically renew based on your chosen billing cycle (monthly or yearly) unless cancelled
  • Cancel anytime by uninstalling the app from your Shopify admin
  • Cancellation takes effect at the end of your current billing period
  • No refunds for partial billing periods (industry standard)
  • Access continues until the end of your paid period

Payment Failures

If payment fails, Shopify will attempt collection according to their policies. We may temporarily suspend app functionality until payment is resolved, but we'll notify you first and work with you to resolve any issues.

5. User Responsibilities and Acceptable Use

Your Responsibilities

  • Accurate Information: Provide accurate store and contact information
  • Security: Maintain the security of your Shopify admin credentials
  • Compliance: Follow all applicable laws and Shopify's policies
  • Fair Usage: Use our apps within reasonable usage limits
  • Updates: Keep your Shopify store and our apps updated

Prohibited Activities

  • Using our apps for illegal activities or fraud
  • Attempting to reverse engineer, hack, or compromise our services
  • Sharing account access with unauthorized parties
  • Using apps to spam customers or violate privacy laws
  • Circumventing usage limits or payment obligations
  • Interfering with other users' access to our services

6. Service Availability and Support

Service Level Commitments

  • Uptime Target: 99.5% monthly uptime (excluding planned maintenance)
  • Support Response: 24-hour response to support requests
  • Maintenance Windows: Scheduled maintenance with advance notice
  • Status Updates: Real-time status information for any service issues

Limitations

Our apps depend on Shopify's platform. Service disruptions beyond our control (Shopify downtime, API changes, etc.) may affect functionality. We'll communicate any known issues promptly.

7. Termination and Data Handling

How to Terminate

  • By You: Uninstall the app from your Shopify admin anytime
  • By Us: We may terminate for breach of terms with 30 days notice (immediate for serious violations)
  • Automatic: Termination if your Shopify store is closed or suspended

Data Deletion Policy

We automatically delete all your app data within 48 hours of uninstallation.

What Happens When You Uninstall

  • Billing stops immediately (no charges for unused time)
  • App functionality is disabled within 24 hours
  • All app configuration and data deleted within 48 hours
  • Your Shopify store data remains unchanged
  • You can reinstall anytime with a fresh setup

8. Intellectual Property Rights

Our Rights

  • We own all rights to our app code, features, and related intellectual property
  • You receive a limited, non-exclusive license to use our apps during your subscription
  • Our apps may not be copied, modified, or redistributed

Your Rights

  • You retain full ownership of all your store data and customer information
  • Your product descriptions, images, and store content remain yours
  • You can export your data anytime while subscribed

9. Limitation of Liability and Disclaimers

Service "As Is"

Our apps are provided "as is" and "as available" without warranties of any kind, whether express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law:

  • Total Liability Cap: Our total liability for all claims is limited to the fees you paid in the 12 months before the claim
  • Excluded Damages: We are not liable for indirect, incidental, special, consequential, or punitive damages
  • Business Losses: We're not responsible for lost profits, revenue, data, business opportunities, or cost of substitute services
  • Data Loss: While we implement security measures, we're not liable for any data loss or corruption
  • Service Interruptions: We're not liable for service downtime, maintenance, or platform dependencies

Third-Party Dependencies

Our apps depend on Shopify's platform and third-party services including Google Cloud US and EU. We're not responsible for issues caused by external services, platform changes, or third-party actions, but we'll assist with reasonable troubleshooting.

Your Responsibility

You're responsible for backing up your data and ensuring our apps meet your specific business needs before installation.

10. Privacy and Data Protection

Your privacy is important to us. Please review our comprehensive Privacy Policy which details:

  • What data we access and why (minimal, purpose-specific)
  • How we protect your information (industry-standard security)
  • Your rights and how to exercise them (24-hour response)
  • Our 48-hour data deletion commitment

11. Updates and Changes

App Updates

We regularly update our apps to add features, improve performance, and maintain compatibility with Shopify. Updates are applied automatically and don't require action from you.

Terms Changes

We may update these Terms occasionally. Continued use after changes take effect means you accept the updated Terms.

12. Dispute Resolution

Our Approach

We believe in resolving issues through direct communication rather than legal procedures. If you have concerns about our service, please contact us first.

Resolution Process

  1. Direct Contact: Email us at hello@appfleece.com with your concerns
  2. Good Faith Discussion: We'll work together to find a fair solution within 30 days
  3. Escalation: If needed, disputes will be resolved under Czech law in Czech courts

Governing Law

These Terms are governed by Czech law. For EU customers, this doesn't limit your consumer protection rights under local law.
